Coroners inquest scheduled in 2019 death of Nelson-area man

A coroner's inquest will examine the death of Zachary Andrew Bryan With on Aug. 19 at Nelson's courthouse.

BC Coroners Service announced the the inquest Monday, over five years after With was killed in an incident involving the RCMP. The announcement does not provide details of With's death, other than that it was reported to the Coroners Service on Feb. 16, 2019.

A spokesperson for the Independent Investigations Office (IIO), which responds to any civilian death involving a police officer, told the Nelson Star that the Police Act prevents it from releasing the names of people involved. However, they said the case appears to be dated during the same month a Bonnington man was killed after he hit an officer with a truck and threatened to strike him again before being struck by a bullet from the officer's firearm.

The names of the driver and officer were never previously released, but the IIO exonerated the officer in a December 2019 decision. The driver had been found to have a blood alcohol content of more than three times the driving limit and also tested positive for illicit drugs.

Coroner's inquests are mandatory for any deaths that occur while a person is detained by or in custody of police officers. The inquests cannot convict an officer. They can only determine the facts of the death and make recommendations to prevent similar fatalities from occurring.
